Yumibio is particularly careful to respect the law and consumer rights. To guarantee you a safe shopping experience, on this page we explain your rights and how to exercise them.
The following General Conditions of Sale regulate the offer and sale of products on this website www.yumibio.com (Site). The products purchased on the Site are offered and sold by Feronia Italia srls with registered office in Castellammare di Stabia, traversa fondo d'orto n. 11 (80053), share capital 2,900.00 iv, registered with the Chamber of Commerce of Naples, VAT number 08605841215 (Yumibio).
1. Scope of application
1.1 The sale of products via the Site (Products) constitutes a distance contract governed by Chapter I, Title III (articles 45 et seq.) of Legislative Decree 6 September 2005, n. 206 (Consumer Code) and by Legislative Decree 9 April 2003, n. 70, containing the rules of electronic commerce.
1.2 The General Conditions of Sale may be modified at any time. Any modifications and/or new conditions will be in force from the moment of their publication on the Site. For this reason, users are invited to regularly access the Site and to consult, before making any purchase, the most updated version of the General Conditions of Sale. The applicable General Conditions of Sale are those in force on the date of sending the purchase order.
1.3 These General Conditions of Sale do not regulate the sale of products and/or the provision of services by parties other than Yumibio that are present on the Site via links, banners or other hypertext links. Before carrying out commercial transactions with such parties, it is necessary to verify their conditions of sale. Yumibio is not responsible for the provision of services and/or the sale of products by such parties. Yumibio does not carry out any checks and/or monitoring on the websites that can be consulted via such links. Yumibio is therefore not responsible for the contents of such sites nor for any errors and/or omissions and/or violations of the law by the same.
2. Purchases on the Site
2.1 Access to sales made through the Site is reserved exclusively for users who are 18 years of age or older.
2.2 Yumibio reserves the right to refuse or cancel orders that come from (i) a user with whom it has an ongoing legal dispute; (ii) a user who has previously violated these General Conditions of Sale and/or the conditions and/or terms of a purchase contract with Yumibio; (iii) a user who has been involved in fraud of any kind and, in particular, fraud relating to credit card payments; (iv) users who have provided false, incomplete or otherwise inaccurate identification data or who have not promptly sent Yumibio the documents requested by the latter on the basis of these General Conditions of Sale or who have sent invalid documents; (v) users who do not provide sufficient guarantees of solvency.
3. Registration on the Site
3.1 The registration credentials for the Site must be used exclusively by the user and cannot be transferred to third parties. The user undertakes to keep them secret and to ensure that no one has access to them, as well as to inform Yumibio without delay, by contacting it, in case of suspected improper use and/or disclosure of the same. The user guarantees that the personal information provided during the registration procedure for the Site is complete and truthful. The user agrees to hold Yumibio harmless from any damage, compensation obligation and/or sanction deriving from and/or in any way connected to the violation by the user of the rules on registration for the Site or on the storage of the registration credentials.
4. Information aimed at concluding the contract
4.1 In compliance with Legislative Decree 9 April 2003, n. 70 containing provisions on electronic commerce, Yumibio informs the user that:
- to conclude the purchase contract for one or more Products on the Site, the user must fill out an order form in electronic format and send it to Yumibio, electronically, following the instructions that will appear from time to time on the Site and that will accompany the various phases of the purchase;
- the contract is concluded when the order form reaches the Yumibio server.
4.2 Once the order form has been registered and confirmation of the authorization to pay the total amount due has been received, Yumibio will send the user, via email to the email address indicated, the order confirmation, containing information relating to the characteristics of the purchased Product, the detailed indication of the price, the payment method used, information on the right of withdrawal (if existing in relation to the purchased product), delivery costs and any additional costs as well as the Customer Service contacts, to whom the user can contact to request assistance and/or submit complaints. It is recommended to keep the email received as proof of purchase.
5. Validity of offers and prices
5.1 All Product prices are expressed in Euro (€) and are inclusive of Value Added Tax ("VAT"). Any additional costs will be expressly and separately indicated in the order form, before the user proceeds to transmit the same.
5.2 The price of the Products may be modified by Yumibio at any time, without notice, it being understood that the price charged to the user will be the one published on the information sheet illustrating the main characteristics of the Product (Product Sheet) at the time the order is sent. Any variations (increases or decreases) in price subsequent to the transmission of the order will not be taken into account.
5.3 Products may be offered for sale on the Site at discounted prices. The full price indicated on the Site (Crossed Out Price) and on which the discount that Yumibio applies is calculated corresponds to the list price published on the Site prior to the publication of the discount.
6. Purchase Orders - Product Information
6.1 The amount due for each order consists of the purchase price, delivery costs, if applicable, and any other additional costs, as indicated in the order form (Total Amount Due). In the event that the Total Amount Due is not paid or the successful payment is not confirmed, the purchase contract will be considered terminated by law pursuant to and for the purposes of art. 1456 of the Italian Civil Code.
6.2 The Products will remain the property of Yumibio until the Total Amount Due has been paid by the user. The risk of loss or damage to the Products, for reasons not attributable to Yumibio, will instead be transferred to the user when the user, or a third party designated by the user and other than the carrier, physically takes possession of the Products.
6.3 Each Product is accompanied by a Product Sheet. The images and descriptions on the Site reproduce the characteristics of the Products as faithfully as possible. The images and colours of the Product in the Product Sheet may differ from the actual product. These images must therefore be considered indicative and with the usual tolerances. For the purposes of the purchase contract, the description of the Product contained in the order form sent by the user will be valid.
7. Product Availability
7.1 The Products offered on the Site are limited in number. It may therefore happen, also due to the possibility that multiple users purchase the same Product at the same time, that the ordered Product is no longer available after the purchase order has been sent.
7.2 In any case of unavailability of the ordered Product, without prejudice to the rights granted to the user by law, and, in particular, by Chapter XIV of Title II of Book IV of the Civil Code, the user will be promptly informed by e-mail. The user will therefore be entitled to immediately terminate the contract, without prejudice to the right to compensation for damages, pursuant to and for the purposes of the provisions of art. 61, paragraphs IV and V, of the Consumer Code. In the event that the user avails himself of the right of termination pursuant to art. 61, paragraphs IV and V, of the Consumer Code or in any case in which the payment of the Total Amount Due has already occurred, Yumibio, without prejudice to the user's right to compensation for damages, will refund such amount without undue delay and, in any case, within a maximum of 15 working days from the sending of the order. The amount of the refund will be communicated to the user by e-mail. This amount will be credited to the same payment method used by the user for the purchase. Any delays in crediting may depend on the banking institution, the type of credit card or the payment solution used. In any case, the value date will be the same as the charge.
7.3 In the case of orders involving multiple Products (Multiple Order), if the subsequent unavailability concerns only some of the Products in the Multiple Order – without prejudice to the rights granted to the user by law, and, in particular, by Chapter XIV of Title II of Book IV of the Civil Code, and without prejudice to the application of art. 7.2 above, if the subsequent unavailability concerns all the Products in the order – Yumibio will immediately notify the user by email. The user will therefore be entitled to immediately terminate the contract, limited to the Product(s) that have become unavailable, without prejudice to the right to compensation for damages, pursuant to and for the purposes of the provisions of art. 61, paragraphs IV and V, of the Consumer Code. In the event that the user avails himself of the right of termination pursuant to art. 61, paragraphs IV and V, Consumer Code, in relation to the Product(s) that have become unavailable or in any case in which the payment of the Total Amount Due has already occurred, Yumibio, without prejudice to the user's right to compensation for damages, will refund the amount due in relation to such Product(s), including delivery costs, calculated as indicated in art. 8.2 below, and any other additional costs due specifically in relation to such Products (Partial Amount Due) without undue delay and, in any case, within a maximum of 15 working days from the sending of the order. The amount of the refund will be communicated to the user via email. This amount will be credited to the same payment method used by the user for the purchase. Any delays in crediting may depend on the banking institution, the type of credit card or the payment solution used. The resolution of the entire Multiple Order will be possible only in the case of evident and proven accessoriness of the Products subject to the Multiple Order which have become unavailable with respect to the other available Products subject to the Multiple Order.
8. Delivery of purchased Products
8.1 The Products are shipped and delivered worldwide, subject to limitations of the receiving countries, of which the user will be informed before the conclusion of the Purchase Order. If due, the amount of shipping costs due by the user in relation to a specific order, is expressly and separately indicated (in Euros and inclusive of VAT) before the user proceeds to transmit the order. In the event of failure to indicate a specific delivery term, it will take place, in any case, within thirty days from the date of conclusion of the contract.
8.2 In the event of partial withdrawal from Multiple Orders, the amount of delivery costs to be refunded to the user will be quantified in proportion to the value of the Product subject to withdrawal.
8.3 The delivery obligation is fulfilled by transferring the material availability or in any case the control of the Products to the user.
It is up to the user to check the condition of the Product that was delivered to him/her/it has been collected. Without prejudice to the fact that the risk of loss or damage to the Products, for reasons not attributable to Yumibio, is transferred to the user when the user, or a third party designated by the user and other than the carrier, physically takes possession of the Product, the user is advised to check the number of Products received and that the packaging is intact, not damaged, not wet or otherwise altered, including the sealing materials and is invited, in his/her interest, to indicate any anomalies on the carrier's transport document, accepting the package with reservation. In fact, the receipt of the Products without reservations does not allow the user to take legal action against the courier, in the event of loss or damage to the Products, except in the case in which the loss or damage is due to fraud or gross negligence of the courier himself/herself and with the exception of partial loss or damage not recognizable at the time of delivery, provided that in the latter case, the damage is reported as soon as it is discovered and no later than eight days after receipt. In the event that the package shows obvious signs of tampering or alteration, the user is also advised to promptly notify Customer Service. In any case, the application of the rules regarding the right of withdrawal and the legal guarantee of conformity remains unchanged.
8.4 The provisions of art. 61 of the Consumer Code shall apply in the event that the purchased Product is not delivered or is delivered late with respect to the delivery terms indicated during the purchase process and in the order confirmation.
In any case, Yumibio undertakes to inform the user, promptly and by email, of the delay in delivery (Delay Notice Email), indicating at the same time the new delivery term, if available (New Delivery Term), without prejudice to the user's rights pursuant to art. 61 of the Consumer Code and the possibility of availing oneself at any time of the ordinary means of protection made available by law and, in particular, by Chapter XIV of Title II of Book IV of the Civil Code.
9. Payment Methods
9.1 Payment for the Products can be made by credit card, through the PayPal payment solution, by bank transfer or by cash on delivery. In the event that one of these payment methods/solutions cannot be used in relation to a specific product, this will be clearly indicated on the Site, at the latest at the beginning of the purchase procedure.
9.2 For the issuing of the invoice, the information provided by the user will be considered valid, which he declares and guarantees to be true, obliging himself to hold Yumibio harmless and indemnified from any damage, including sanctions issued by the competent authorities, which may arise in the event of the information not being true.
9.3 Payment by credit card
9.3.1 Payment for the Products can be made by credit card directly through the Site. Yumibio accepts Visa, Mastercard and American Express credit cards. In any case, they are indicated in the footer of each page of the Site.
9.3.2 In order to guarantee the security of payments made on the Site and prevent any fraud, Yumibio reserves the right to ask the user, via email, to send, via the same means, a copy of the front/back of his/her identity card and, in the event that the holder of the order is different from the holder of the card, of the identity card of the latter. The document must be valid. The request email will specify the deadline by which the document must reach Yumibio. This deadline will not, in any case, exceed 5 working days from receipt of the request by the user. While waiting for the requested document, the order will be suspended. The user is required to send the requested documents within the indicated deadline.
9.3.3 In the event that Yumibio does not receive such documents within the time specified in the request email or receives expired or invalid documents, the contract will be considered terminated by operation of law pursuant to and for the purposes of art. 1456 of the Italian Civil Code and the order will consequently be cancelled, without prejudice to Yumibio's right to compensation for any damages it may have incurred due to the user's non-compliant behavior. The termination of the contract, of which the user will be notified by email, no later than 5 working days from the expiry of the deadline for sending the documents requested by Yumibio, will result in the cancellation of the order, with consequent reimbursement of the Total Amount Due.
9.3.4 In the event that Yumibio receives valid documentation within the time frame indicated in the email referred to in Article 9.3.2 above, the delivery terms will run from the date of receipt of the same.
9.3.5 Confidential credit card data (card number, cardholder, expiration date, security code) are encrypted and transmitted directly to the payment manager without passing through the servers used by Yumibio. Yumibio therefore never has access to and does not store the credit card data used by the user to pay for the Products, except, limited to the data relating to the cardholder, the case provided for in articles 9.3.2 and 9.3.3.
9.4 Payment via PayPal payment solution
9.4.1 Payment for the Products purchased on the Site can be made using the PayPal payment solution. If the user chooses PayPal as a payment method, he/she will be redirected to the site www.paypal.it where he/she will make the payment for the Products according to the procedure provided and regulated by PayPal and the terms and conditions of the contract agreed between the user and PayPal. The data entered on the PayPal site will be processed directly by the latter and will not be transmitted or shared with Yumibio. The latter is therefore not able to know and does not store in any way the data of the credit card linked to the user's PayPal account or the data of any other payment instrument connected to that account.
9.4.2 In the case of payment via PayPal, the Total Amount Due will be charged by PayPal to the user at the same time as the conclusion of the contract via the Site. In the event of termination of the purchase contract and in any other case of reimbursement, for any reason, the amount of the reimbursement due to the user will be credited to the user's PayPal account. The times for crediting the payment instrument linked to such account depend exclusively on PayPal and the banking system. Once the credit order has been placed in favor of such account, Yumibio cannot be held responsible for any delays or omissions in crediting the user with the reimbursement amount, for which the user must contact PayPal directly.
9.5 Payment by bank transfer
9.5.1 The user who has placed a purchase order can pay by advance bank transfer; in this case the user will receive the coordinates and instructions for completing the transfer via the purchase order confirmation email.
9.5.2 In the case of payment by bank transfer, the order will be shipped only after the amount has been credited to Yumibio.
9.6 Payment by cash on delivery
9.6.1 The user is offered the possibility of paying for the Products in cash, upon delivery to the recipient.
9.6.2 If the user chooses cash on delivery as the payment method, an additional cost of Euro 4.00 (VAT included) will be applied, which will be indicated in the order form and included in the total amount due.
9.6.3 In the case of payment by cash on delivery, the customer must have, at the time of delivery, the exact Total Amount Due, in cash. The courier is not authorized to accept checks and cannot give change. In the event that, for any reason, the customer who has chosen cash on delivery as a means of payment should be entitled to a refund from Yumibio, the latter will agree by email with the customer on the methods of carrying out such refund.
9.6.4 If the customer who has chosen cash on delivery as a means of payment has refused - more than twice - to receive the package offered for delivery by the courier, Yumibio reserves the right not to accept orders from the customer in question.
9.7 Payment via Amazon Pay
9.7.1 The user can also purchase the Products using the service offered by Amazon and called “Amazon Pay”. This service allows the user to use the payment methods already associated with their Amazon account to pay for the Products. For more information or to manage this feature, Yumibio invites the user to view the information page published directly by Amazon and reachable at the following link.
10. Right of Withdrawal
10.1 If the right of withdrawal cannot be exercised for the product ordered, appropriate communication will be given in the Product Sheet and during the purchase process.
10.2 If, however, the right of withdrawal exists in relation to the purchased Product because the item in question is not a perishable item, the following articles apply.
10.3 The user who is a consumer has the right to withdraw from the contract concluded with Yumibio, without having to bear costs other than those indicated in this article and without having to specify the reason, within fourteen (14) calendar days (Withdrawal Period). The Withdrawal Period expires after 14 days:
- in the case of an order relating to a single Product, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the Product;
- in the case of a Multiple Order with separate deliveries, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last Product; or
- in the case of an order relating to the delivery of a Product consisting of multiple lots or pieces, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last lot or piece.
10.4 To exercise the right of withdrawal, the user must inform Yumibio of his decision to withdraw, before the expiry of the Withdrawal Period.
10.5 To this end, the user can:
- use the standard withdrawal form (Standard Withdrawal Form) made available to you on the Site via a specific link, before the conclusion of the contract, and, in any case, via the “Right of Withdrawal” link on the Site; or
- submit any other explicit declaration of your decision to withdraw from the contract (Withdrawal Declaration), which you can send to the email address sito@yumibio.com or via the “Contact Us” page.
The Standard Withdrawal Form or the Withdrawal Declaration must be sent to the following email address: sito@yumibio.com
Since the burden of proof relating to the exercise of the right of withdrawal before the expiry of the Withdrawal Period lies with the user, it is in the user's interest to use a durable medium when communicating his/her withdrawal to Yumibio.
10.6 To return the Product, the user can use a carrier of his/her choice with return costs borne by the user: in this case, the user, after having exercised the right of withdrawal in the manner indicated in this article, must return the Product to Yumibio, using a carrier of his/her choice and at his/her own expense, without undue delay and in any case within 14 calendar days from the date on which he/she communicated to Yumibio his/her decision to withdraw. The deadline is respected if the user sends the Product back before the expiry of the fourteen-day period. The Product, appropriately protected and packaged, must be sent to the following address: Feronia Italia srls, Castellammare di Stabia, traversa fondo d'orto n. 11 (80053).
The direct costs of returning the Product to Yumibio are borne by the user. The return of the Product to Yumibio is under the user's responsibility; the product is considered returned when it is delivered to the carrier.
If the user has used a discount code to purchase the Product for which he/she has exercised the right of withdrawal, the refund will be made only with reference to the sum of money actually spent by the user, and not also with regard to the value of the discount code.
10.7 If the user withdraws from the contract, Yumibio will refund the Total Amount Due paid by the user for the Product, including delivery costs, if applicable, without undue delay and in any case no later than 14 calendar days from the day on which Yumibio was informed of the user's decision to withdraw from the contract. Yumibio may in any case suspend the refund until receipt of the Products subject to withdrawal or until the user demonstrates having returned such Products, if earlier. The refund will be made using the same means of payment used by the user for the initial transaction, if possible. If the user has paid for the Product by cash on delivery, the refund will be made to the bank details communicated by the user. In any case, the user will not have to bear any costs as a consequence of the refund.
10.8 In the event of partial withdrawal, the amount of delivery costs to be refunded to the user following the withdrawal will be calculated as indicated in the preceding art. 8.2.
10.9 The Product must in any case be stored, handled and inspected with normal diligence and returned intact, complete in all its parts, perfectly functioning, accompanied by all accessories and information sheets, with the identification tags, labels and disposable seal, where present, still attached to the Product and intact and not tampered with, as well as perfectly suitable for the use for which it is intended and free from signs of wear or dirt. Furthermore, the withdrawal applies to the Product in its entirety. It cannot therefore be exercised in relation to parts and/or accessories (which do not constitute autonomous Products) of the Product.
10.10 Pursuant to art. 59 of the Consumer Code, the right of withdrawal is excluded for the supply of sealed goods that are not suitable for return for hygiene reasons and have been opened after delivery. Consequently, for cosmetic products (e.g. lipsticks) that are opened, the user loses the right of withdrawal as these Products cannot be returned for hygiene reasons. In the event that the withdrawal has not been exercised in accordance with the provisions of the applicable legislation, it will not result in the termination of the contract and, consequently, will not give the right to any refund. Yumibio will notify the user within 5 working days of receiving the Product, rejecting the request for withdrawal. The Product, if already received by Yumibio, will remain at Yumibio at the user's disposal for collection, which must take place at the user's expense and under his/her responsibility.
10.11 In the event that the Product for which the right of withdrawal has been exercised has suffered a decrease in value resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the Product, the refund amount will be reduced by an amount equal to such decrease in value. Yumibio will notify the user of the circumstance and the resulting decreased refund amount within 5 working days of receiving the Product, providing the user, in the event that the refund has already been paid, with the bank details for the payment of the amount owed by the user due to the decrease in value of the Product.
11. Discount codes and Gift Cards. Expiring products
11.1 On the Site it is also possible to purchase using discount codes issued by Yumibio. Discount codes may also be issued following a purchase on the Site.
11.2 If the value of the discount code is lower than the order value, the remaining amount can be completed using the payment methods provided on the Site. Discount codes cannot be combined with each other for a single purchase. Discount codes can also be used to purchase Products already on promotion. It is not possible to use discount codes for payments of amounts lower than their value. Each discount code can be used for one purchase only. In no case do discount codes give the right to change in the case of purchases of a lower amount.
11.3 Any Products for which it will not be possible to use discount codes will be duly reported on the Site. In the event of cancellation for any reason of an order for which a discount code has been used, the relevant amount will be credited back to the customer's personal account.
11.4 Under no circumstances can discount codes be converted into cash.
11.5 On the Site it is also possible to purchase using single-use Gift Cards issued by Yumibio. If the value of the Gift Card is less than that of the order, the remaining amount can be completed according to the payment methods provided on the Site.
11.6 Gift Cards can be used to pay for amounts less than their value. In this case, however, the residual amount can no longer be used for subsequent purchases and will be lost.
11.7 Any Products for which it will not be possible to use Gift Cards will be duly indicated on the Site. In the event of cancellation for any reason of an order for which a Gift Card has been used, the relevant amount will be credited back to the same.
11.8 Under no circumstances can Gift Cards be converted into cash.
11.9 Expiring Products may be offered on the Site, meaning Products that can no longer be used in accordance with the law within an indicative period of 30 days from their presentation on the Site. In this context, the Site may offer the user the possibility of reserving the expiring Product and inserting it into a purchase order for both the expiring Product and one or more Products offered for sale on the Site, without paying the cost for the expiring Product. In this case, the user undertakes not to promote any type of action if the expiring Product was delivered close to the expiry date and therefore it was not possible to use it.
12. Exclusion of liability
12.1 The user accepts that Yumibio is in no way responsible for damages that the Products may cause to the user or to third parties. This exclusion of liability extends in particular to any damages resulting from allergies or intolerances to one or more Products or to one or more substances that compose the Products.
12.2 For each Product purchased through the Site, within 7 days of shipment, the registered user can publish a review in the Product Sheet of the purchased Product, if deemed relevant and suitable at the sole discretion of Yumibio. Once published, reviews can only be deleted upon request to Yumibio. Yumibio cannot be held responsible for the content published by users. Yumibio reserves the right to remove reviews deemed unsuitable without notice.
12.3 The user can contact Yumibio to receive a personalized consultancy service regarding the Products offered for sale on the Site. This service does not imply any commitment, obligation or responsibility of Yumibio towards the user. The consultancy offered through the Site is based exclusively on the information provided by the user and does not include analysis of medical data or body analysis, therefore it is not intended to replace medical or professional advice. The user is invited, in any case, to communicate to Yumibio the presence of any intolerance or allergy to any product or substance, in order to avoid the onset of allergic reactions to any of the ingredients contained in the Products.
12.4 Yumibio is in no way responsible if the Product is not to the user's liking due to purely subjective evaluations of the latter and independent of defects of conformity governed by articles 128-135 of Legislative Decree 6 September 2005, n. 206 (Consumer Code).
13. Legal Guarantee of Conformity
All Products sold on the Site are covered by the Legal Guarantee of Conformity provided for by articles 128-135 of the Consumer Code (Legal Guarantee).
14. Applicable law and competent court; out-of-court settlement of disputes
Alternative Dispute Resolution/Online Dispute Resolution
14.1 Contracts concluded between users of the Site and Yumibio are governed by Italian law and the competent court is Torre Annunziata. The application to consumer users who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided for by the law of the country in which they have their habitual residence is reserved, in particular in relation to the deadline for exercising the right of withdrawal, the deadline for returning the Products, in the event of exercising this right, the methods and formalities of communicating the same and the legal guarantee of conformity.
14.2 Please remember that in the case of a consumer user, any dispute relating to the application, execution and interpretation of these General Conditions of Sale will be subject to the jurisdiction of the court of the place where the user resides or has elected domicile.
14.3 Pursuant to art. 141-sexies, paragraph 3 of the Consumer Code, Yumibio informs the user who qualifies as a consumer pursuant to art. 3, paragraph 1, letter a) of the Consumer Code, that, in the event that he has submitted a complaint directly to Yumibio, following which it has not been possible to resolve the dispute thus arising, Yumibio will provide information regarding the Alternative Dispute Resolution body or bodies for the extrajudicial resolution of disputes relating to obligations arising from a contract concluded on the basis of these General Conditions of Sale (so-called ADR bodies, as indicated in articles 141-bis et seq. of the Consumer Code), specifying whether or not he intends to avail himself of such bodies to resolve the dispute itself.
Yumibio also informs the user who qualifies as a consumer pursuant to art. 3, paragraph 1, letter a) of the Consumer Code that a European platform for the online resolution of consumer disputes (so-called ODR platform) has been established. The ODR platform can be consulted at the following address http://ec.europa.eu/consumers/odr/; through the ODR platform the consumer user will be able to consult the list of ADR bodies, find the link to the site of each of them and start an online dispute resolution procedure in which he is involved.
Yumibio invites the consumer to use the email address sito@yumibio.com or the "Contacts" section to directly resolve any type of issue.
In any case, the consumer user's right to bring the dispute arising from these General Conditions of Sale before the competent ordinary court remains intact, regardless of the outcome of the out-of-court settlement procedure for disputes relating to consumer relationships by resorting to the procedures set out in Part V, Title II-bis of the Consumer Code.
14.4 The user who resides in a member state of the European Union other than Italy, may also access, for any dispute relating to the application, execution and interpretation of these General Conditions of Sale, the European procedure established for small claims disputes, by Regulation (EC) no. 861/2007 of the Council, of 11 July 2007, provided that the value of the dispute does not exceed, excluding interest, fees and expenses, Euro 2,000.00.
